The rules, in plain language.

When you sign up for Partake as a couple, you’re entering an agreement with Partake Weddings LLC. When your guests use Partake at your wedding, they’re using the service you set up. These terms cover both.

If anything in this document is unclear, email support@partakeweddings.com and we’ll explain it in plain language. We prefer conversations to lawsuits.

To book Partake you must be at least 18 (or the age of majority where you live) and able to enter a binding contract. By booking, you confirm you meet that requirement.

Partake is not directed to children under 13. Guests under 13 shouldn’t upload content; if you believe a child under 13 has uploaded something, email us and we’ll remove it.

Partake is a web-based guest experience with no app downloads. Features vary by package. The two visible packages are Partake Engage ($149) and Partake Experience ($299). Every package includes a memory portal kept for 12 months from the wedding date, with unlimited couple-side exports during that window.

A package covers one wedding and that couple’s own celebrations on the way to it (for example a bridal shower, bachelorette party, or rehearsal dinner) under the same event, at no additional charge. Some features are date-gated: video uploads to the shared gallery become available on the wedding date, while photo uploads and video guestbook messages are available whenever the event is live. The 12-month retention window is always measured from the wedding date, not from any earlier celebration.

We keep a 99% uptime target. If we’re down during your actual wedding ceremony or reception and it’s our fault, we’ll refund your package in full. That promise isn’t hedged: if your event is live and Partake is broken, you get your money back. Email us from the couple account that booked the event.

Packages are charged as one payment: you create your event and build it for free, and the full package price is charged once, when you choose to go live. There is no deposit and no later balance charge. Payments are processed by Stripe; we never hold card details ourselves.

Your payment is fully refundable until 30 days before the wedding. Inside 30 days of the wedding it is non-refundable. That’s when we’re running the event for you in earnest.

Postponements are different from cancellations. If your wedding moves to a new date, reply to your payment receipt email and we’ll transfer your booking (payment and any progress you’ve made) to the new date at no extra cost.

If Partake fails to deliver: the platform is down on your wedding day because of something on our end, your event data is lost while still inside the 12-month retention window due to our error, or any other failure that’s on us. In any of those cases we’ll refund in full. This policy covers our responsibility to you; it does not cover refunds you might want for reasons outside our control (venue closures, wedding cancellations, etc.).

Founding Couple pricing is a limited promotional offer for early couples. Founder prices are quantity-limited and may end at any time; founder payments are refundable on the same terms as above. Accepting a Founding Couple price also grants Partake a limited, revocable license to use a short public testimonial from you and a few event photos you designate and have the right to share (faces blurred on request) as marketing or social proof. This is a narrow exception to the “we don’t use guest content for marketing” rule below, limited to content you expressly designate.

Some events are set up by a Partake DJ or reseller partner rather than by the couple directly. If a DJ created your event, your DJ is responsible for payment, and you won’t be charged Partake’s package price. The rest of these terms still govern your use of the platform: content ownership, the 12-month retention window, acceptable use, and your rights over your event’s data.

If you operate as a DJ or reseller, your subscription and per-wedding charges, what couple data you may access, and your obligations to the couples you set up are covered by your separate Partake Partner Agreement, which you accept when you start a DJ account. Every event comes with a unique referral link. A couple who books through your link gets $10 off their package, applied automatically at checkout. There is no limit on how many friends can use your link.

The discount applies to the referred couple’s purchase only. It is never paid out as cash and does not create any credit or payout for the referring couple.

As the couple running the event, you agree that you have the right to upload anything you upload (cover photo, love story, guest list, trivia, etc.) and that it’s not defamatory, harassing, or illegal. Partake is not going to police event content, but we reserve the right to remove an event if we receive a credible complaint that something on it is harmful.

You’re responsible for letting your guests know that Partake is in use and that their uploads are shared with the other guests and with you. Our name-entry screen shows this notice, but you should be upfront about it in your physical signage too.

Guests own what they upload. By uploading something to a Partake event, a guest grants the couple the right to view, export, download, print, and keep a copy. Guests also grant Partake a worldwide, royalty-free, non-exclusive license to store, display, and process the file only as needed to run the feature (store it, show it in the gallery, include it in the couple’s memory portal export). That license lasts through the 12-month retention window and covers copies the couple has already exported, even after a guest deletes their own. We don’t use guest content for marketing or to train models, with one narrow exception: photos a Founding Couple expressly designates and has the right to share (see Payment above).

You upload only what you have the right to share. By uploading any photo or video, you represent that you took it or otherwise have permission to share it, and that it doesn’t infringe anyone’s copyright, trademark, privacy, or other rights. This matters most for professional photos (your wedding photographer usually keeps the copyright) and for videos that capture copyrighted music. You’re responsible for the content you upload.

Guests can delete their own uploads any time via the “Delete my data” footer button. Couples can remove anything inappropriate from their memory portal. Photos flagged by a guest are hidden from the gallery immediately and land in the couple’s moderation queue.

Don’t use Partake to upload hateful, harassing, sexually explicit, or illegal content, or content you don’t own or have permission to share. Don’t scrape, probe, or overload the service. Don’t try to access other couples’ events. Don’t use Partake to spam people or to distribute malware.

If we believe in good faith that an account or event is violating these rules, we may pause the event while we investigate and, if needed, remove it. Serious violations are a termination cause.

We respect copyright and expect everyone using Partake to do the same. If you believe content on a Partake event infringes a copyright you own, email our designated agent at support@partakeweddings.com with: (1) your name, as a signature; (2) the work you say was infringed; (3) the event link or enough detail for us to find the material; (4) your contact information; (5) a statement that you believe in good faith the use isn’t authorized; and (6) a statement, under penalty of perjury, that your notice is accurate and that you’re the copyright owner or authorized to act for them.

When we receive a valid notice we remove or disable the material promptly and let the affected couple know. If your content was taken down and you believe that was a mistake, you can send a counter-notice to the same address. We terminate the accounts of couples who repeatedly infringe copyright. Our designated agent for copyright notices is registered with the U.S. Copyright Office.

If a claim arises from content uploaded to your event (including content your guests upload) or from your use of Partake in a way that breaks these terms, you agree to cover us: to defend Partake and reimburse our reasonable costs, including legal fees. This is the normal arrangement for any platform that hosts content other people upload. The person who put the content there is responsible for it, not the host. This survives after your event ends.

The Partake name, logo, design system, The Partake Wizard brand, and the codebase that runs this product are ours. Nothing in these terms gives you the right to use the Partake name to promote other services, or to copy the product in a way that confuses real couples.

Partake hosts photos, videos, and text that couples and guests upload. We don’t pre-screen or endorse that content and aren’t responsible for it. We act as a passive host and take material down when we’re told it’s a problem.

Partake is provided as-is. We work hard to keep it reliable, but software has bugs and the internet has bad days. Beyond the uptime promise described in What you get, we don’t promise that every feature will work perfectly in every browser on every network at every moment.

To the maximum extent allowed by law, Partake’s total liability for anything related to the service is capped at the total amount you’ve paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.

If we ever change these terms in a way that materially affects existing customers, we’ll email every active couple before the change takes effect. Minor wording edits can ship without notice but will update the “last updated” date below.

These terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to conflicts of laws rules. Any dispute that can’t be resolved by email goes to a court in Virginia.
